Commercial Bus Accident in Maryland Injures Philadelphia Teachers and Students En Route to a Washington D.C. Field Trip

Towards the end of the school year, many schools and school districts organize class trips to notable locations and landmarks that would further a child’s understanding of material studied in school. For students in Philadelphia, Pennsylvania, one end of the year trip that is reasonably common is a visit to Washington D.C. The visit may include visits to the White House, Capitol building, monuments and memorials, and the multitude of museums and other attractions.

Most school trips go off without a hitch. Often this is thanks to the careful planning by teachers, parents, and faculty members. However, sometimes despite planning and best efforts, mistakes are made and a serious situation arises.

Improper or Unsafe Passing May Have Caused the Bus Wreck

According to news and police reports of the accident, a group of eighth graders set off from their middle school on the morning of May 15, 2017. The trip seemed to start off smoothly. However, on I-95, about halfway between Wilmington and Baltimore in the area of Havre de Grace, the bus carrying the teachers or students was involved in a serious accident.

The accident occurred at approximately 9:30 a.m. Reports indicate that the driver of a Honda Civic attempted to pass the charter bus on the highway. The driver apparently lost control of his vehicle while attempting to pass the bus causing his vehicle to clip the front wheel of the bus. Due to the bus’s size and weight, this impact was sufficient to result in the bus driver losing control of his vehicle and overturning. The bus struck an embankment and a tree before coming to rest on its side on the highway pavement.

What Happens When a Truck or Bus Accident Happens in a State You Don’t Live In?

When you are injured in an accident on a highway – especially an interstate highway – it is essential that you consider where the accident occurred. Most legal action due to a vehicle accident are state-based in nature. Furthermore, there are certain legal requirements regarding both proper forum and venue. It is essential for an injured person to properly balance these concerns. The failure to do so can lead to an improper filing, accusations of forum shopping, or other mistakes that can make recovery much more difficult.

In this particular situation, there is some tension between the fact that all involved parties were from Pennsylvania and the location of the accident. On one hand, the students, teachers, and bus company are all from Philadelphia. However, the driver of the Honda Civic is a Maryland resident. Theoretically, this fact may even open the door to a lawsuit in federal court on the basis of diversity of parties. Furthermore, there is some tension because the accident occurred in Maryland. Thus, parties may argue that Maryland and not Pennsylvania is the proper forum for legal action. These are all careful considerations that must be assessed and weighed by an attorney prior to filing a lawsuit.
