What are the Limitations on Strict Liability Law in Pennsylvania?

The Pennsylvania Supreme Court recently clarified certain elements of strict liability.  In Pennsylvania, legal action can only be pursued if the product was being used by its intended user, rather than any person at all. The clarification stemmed from a case involving a child who was injured while using a lighter. The Plaintiffs claimed that the lighter was defective because it wasn’t child-proof but the Supreme Court ruled that lighters were not intended for children and therefore were exempt from liability in that case.

In the lighter case, the Pennsylvania Supreme Court determined and drew up a new set of guidelines regarding strict liability that encompassed negligence and design properties as well. If a product was not designed in a way that took into account reasonably foreseeable problems then the manufacturer could still be held accountable for any damages or injuries that occurred from its use.
