Our client was traveling in his personal vehicle on a highway when another vehicle collided with his car. He was taken in for medical treatment. This was a case of extraordinary premises liability negligence and amusement park campsite mismanagement that terribly injured an 11 year old girl when she was struck by a leafless, dead and decayed section of an Ash tree that fell from 40 feet above the campsite. The client’s injuries included a traumatic brain injury, skull fractures, internal bleeding, cognitive deficits, depression, anxiety, disfigurement and scarring with inability to function in her activities of daily living and huge medical bills.

An inspection of the campsite revealed that a significant number of trees on the campsite and adjacent property were infected with Emerald Ash Borer (EAB), specifically the ash trees hanging over the subject campsite. The evidence established that the campground knew or certainly should have known that the subject Ash tree was one of many Ash trees dying rapidly throughout its park grounds and campsite, and that the camp ground had violated U.S. Department of Agriculture Tree Risk Management Standards, American National Standards Institute A3oo, Part 9 Standards and the International Society of Arboriculture (ISA) Best Management Practices for Tree Risk Assessment.
